Terms and conditions of use

1. Subject and Scope

These General Terms and Conditions of Sale (hereinafter "T&C") govern the distance purchase of products (Pokémon, One Piece, Dragon Ball Collectible Cards, Funko Pop, etc.) made on the website cardsattack.com (the "Site").

Acceptance of these T&C is mandatory and unconditional upon order confirmation.

2. Product Information and Availability

2.1 Collectible Products: The user acknowledges that the products sold are often of a collectible nature (sealed, rare, with specific conservation conditions). For used or opened products, the condition (grading/state) will be specified in the product description. The Seller is not responsible for manufacturing defects inside sealed products (e.g., missing or defective cards inside a booster pack). 2.2 Availability: Should a product ordered no longer be available after the order has been submitted, CardsAttack will promptly notify the Buyer and refund the full amount paid within [INSERT NUMBER] working days.

3. Prices and Payment Methods

3.1 Payments: Payments can be made via the secure systems indicated on the "Secure Payments" page, including: Credit/Debit Cards via NEXI; Installment Payments (2-3-4-12 payments) via Alma. 3.2 Payment Data: CardsAttack does not handle or store sensitive payment data.

4. Shipping and Delivery

4.1 Carriers and Service: CardsAttack relies on European-renowned Express Couriers (such as, but not limited to, GLS, DHL, BRT or similar) to ensure traceable and secure delivery. Shipping times and costs vary based on weight, volume, destination, and the service selected by the customer during checkout.

4.2 Risk of Loss and Damage: The risk of loss or damage to the products, for reasons not attributable to the Seller (such as accidents, loss, or damage by the courier), transfers to the Consumer only when the Consumer (or a third party designated by them) physically takes possession of the goods (Art. 63 Consumer Code).

4.3 Insured Shipping (Optional):

  • Option: If the customer wishes to protect themselves against any accidents or package loss during transit, they may expressly request insured shipping.

  • Procedure: This request must be sent via email to hello@cardsattack.com immediately after placing the order, clearly stating the intention to insure the shipment.

  • Cost: The customer will be informed of the additional cost due to insurance, calculated based on the order value, and will be required to pay the corresponding difference before the order is fulfilled.

  • Absence of Request: In the absence of a specific request for insured shipping from the customer, the order will be shipped using the standard, non-insured method.



5. Right of Withdrawal (Returns)

5.1 Exercise of Right: The Buyer, if acting as a "Consumer," has the right to withdraw from the contract within 14 (fourteen) days from the receipt of the products, without providing any reason. 5.2 Exclusions: The right of withdrawal is excluded for (Art. 59 Consumer Code):

  • The supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (e.g., opened Funko Pop boxes, opened card booster packs).

  • The supply of sealed audio or video recordings or sealed computer software which were unsealed after delivery.

  • Goods made to the consumer's specifications or clearly personalized. 5.3 Withdrawal Procedure: The Buyer must communicate the decision via email to hello@cardsattack.com. The return shipping costs are borne by the Consumer.

6. Legal Guarantee of Conformity

CardsAttack is responsible for any lack of conformity that becomes apparent within two years from the delivery of the goods. The Consumer forfeits their rights if they do not notify the Seller of the lack of conformity within two months from the date the defect was discovered.

7. Applicable Law and Competent Jurisdiction

These T&C are governed by Italian law. For any dispute, if the Buyer is a Consumer, the competent court is that of the Consumer's residence or domicile. In all other cases, the exclusive competent court is that of Naples, Italy.
